IMPORTANT: RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
You hereby acknowledge and agree that use of Conscious Body Recovery’s (“CBR”) facilities, services, equipment, or premises involves inherent risks of injury to persons and property, including those described below, and that you assume full responsibility for such risks.
User Responsibility
You accept full responsibility for your personal health and safety while using the sauna, cold plunge, and/or shower at Conscious Body Recovery, located within Self Made Training Facility San Diego. You acknowledge that you are voluntarily participating in contrast therapy (infrared sauna and cold plunge) and assume all risk unto yourself. You declare that you are physically and mentally capable of participating in hot and cold therapy, and will not misrepresent your ability to operate all equipment while at Conscious Body Recovery.

Medical Conditions & Sauna Use:

Individuals with cardiovascular issues, obesity, diabetes, or a history of heart disease, high or low blood pressure, or circulatory problems should consult a physician prior to use. Heat stress increases cardiac output and blood flow, potentially raising heart rate by 30 beats per minute for each degree increase in core body temperature.

Medications:

Prescription drugs may induce drowsiness or affect heart rate, blood pressure, and circulation. Diuretics, barbiturates, beta-blockers, and antihistamines can impair the body’s ability to regulate heat or sweating. Consult a physician if you are on any medications.

Alcohol & Drug Abuse:
-
Using a sauna while intoxicated or under the influence of drugs can lead to unconsciousness due to impaired judgment and increased heart rate. It is not advisable to “sweat out” a hangover.

Elderly:
-
With age, the ability to regulate core body temperature decreases. If elderly, use the sauna at a lower temperature for no more than 15 minutes at a time. For the cold plunge, start gradually (e.g., just hands for the first week) and do not submerge body parts for longer than 1–2 minutes.

Children:

Children’s core body temperature rises faster than adults. Children under 16 should not use the cold plunge. When using the infrared sauna with a child, keep temperature low and limit to 15 minutes at a time.

Chronic Conditions:

Diseases associated with reduced ability to sweat or perspire (e.g., Multiple Sclerosis, Central Nervous System Tumors, Diabetes with Neuropathy) can impair safe use of heat therapy. Consult a physician.

Hemophiliacs / Individuals Prone to Bleeding:
-
Anyone predisposed to bleeding should avoid using infrared saunas.

Fever & Insensitivity to Heat:
-
Do not use the sauna if you have a fever or insensitivity to heat until symptoms subside.

Pregnancy:
-
Pregnant women should consult a physician before using an infrared sauna.

Menstruation:
-
Heating of the low back area may temporarily increase menstrual flow. This should not preclude sauna use, but do not use the cold plunge. Sit on a towel inside the sauna.

Joint Injury:
-
Avoid heating acute joint injuries for the first 48 hours or until swelling subsides. Chronically hot or swollen joints may respond poorly to vigorous heating.

Implants (Metal / Surgical):
-
Metal pins, rods, and artificial joints generally reflect infrared waves. Consult a physician regarding any concerns.

Pacemakers / Defibrillators:
-
Magnets used in sauna assembly can interrupt pacemakers. Discuss potential risks with your doctor.
Infrared Sauna Use Recommendations
-
Hydrate with at least 8 oz. of water before use to prepare for increased core temperature.
-
Sit on provided towels to absorb sweat.
-
Optimal sauna temperature ranges from 100°F to 130°F.
-
Start with 15–20 minute sessions at 100°F several times a week, then gradually increase to 40–60 minutes if comfortable.

Sweating may take a few sessions to develop and will help remove toxins.
-
Move slowly and exit if you experience lightheadedness or dizziness.
-
After your session, cool down with a shower and rehydrate (24 oz. of water or electrolytes).
Cold Plunge Use Recommendations

Consult a physician if you have concerns about cold water immersion.
-
Enter and exit the cold plunge with caution.
-
Take 5–10 deep breaths before immersion; always focus on your breathing.
-
Begin gradually: stand in the plunge for 1–2 minutes, then submerge waist-deep for 1–2 minutes, building tolerance over time.
-
Do not exceed 10 minutes at a time unless you are experienced.
-
Keep the door open unless you’re experienced with cold therapy.
-
Warm up afterward with the sauna or a warm shower.
Note: Infrared sauna or cold plunge use is not implied to cure or treat any disease. Drinking electrolytes, water, or a sports drink before and after use is strongly recommended.
RELEASE OF LIABILITY / HOLD HARMLESS
In consideration of being permitted to enter any part of any Conscious Body Recovery facility, you hereby release and hold Conscious Body Recovery harmless from all liability for any loss or damage, giving up any claim or demand on account of injury to person or property, whether caused by active or passive negligence or otherwise, to the fullest extent permitted by law, while you are in, upon, or about Conscious Body Recovery premises or using any CBR facilities, services, or equipment.
Arbitration
IF YOU ARE NOT OTHERWISE BOUND BY AN ARBITRATION AGREEMENT WITH US, YOU AGREE THAT ANY DISPUTE (OTHER THAN ONE FILED IN A COURT LIMITED TO SMALL CLAIMS) BETWEEN YOU AND CONSCIOUS BODY RECOVERY OR ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, SHALL BE RESOLVED BY A SINGLE ARBITRATOR UNDER THE CURRENT RULES OF THE AMERICAN ARBITRATION ASSOCIATION, RATHER THAN BY LITIGATION IN COURT. YOU ALSO AGREE THAT THE FEDERAL ARBITRATION ACT GOVERNS THE ARBITRABILITY OF ALL DISPUTES. IF YOU DO NOT WANT TO BE BOUND BY THIS ARBITRATION PROVISION, YOU MUST NOTIFY US IN WRITING AT 4030B SPORTS ARENA BLVD, SAN DIEGO, CA 92110, WITHIN 30 DAYS OF THE DATE YOU FIRST USE ANY OF OUR SERVICES. YOU AGREE NOT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE ACTION AGAINST CONSCIOUS BODY RECOVERY. IF THE ARBITRATOR FINDS THAT THIS ARBITRATION AGREEMENT OR CLASS WAIVER IS UNENFORCEABLE, THE ENTIRE ARBITRATION PROVISION SHALL BE NULL AND VOID, AND EITHER PARTY MAY FILE THE ACTION IN COURT.
Indemnification
You agree to indemnify, defend, and hold harmless Conscious Body Recovery, its affiliates, employees, agents, third-party providers, and their respective officers and directors from any losses, expenses, damages, and costs (including reasonable attorney fees) resulting from any violation of these terms or misuse of CBR facilities. Conscious Body Recovery reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with all reasonable requests in asserting any available defenses.
